Among state-level actions, New York recently became the first to enact a statewide moratorium through executive order on July 15, 2026, pausing environmental permits for data centers consuming at least 50 megawatts of power for up to one year. Conversely, in Maine, a legislative ban on permitting data centers until November 2027 was vetoed by Governor Janet Mills in April 2026. On the federal level, Senator Bernie Sanders and Representative Alexandria Ocasio-Cortez have introduced the Artificial Intelligence Data Center Moratorium Act, targeting projects with peak power loads exceeding 20 megawatts or using liquid cooling systems. House Energy and Commerce Ranking Member Frank Pallone Jr. has also called for a national moratorium. The report underscores that these pauses are driven by genuine public concerns over residential electricity rate increases, groundwater depletion, and localized air pollution.
