  • District Restrictions: Data centers larger than 250,000 square feet are restricted exclusively to industrial areas in the M-3 district and require a Conditional Use Permit. Facilities between 50,000 and 250,000 square feet are restricted to EZ-1, M-2, M-3, and PEC districts. Smaller facilities under 50,000 square feet are permitted only in light manufacturing or industrial zones.
  • Generator and Turbine Limits: Backup generator testing is restricted to once per week between the hours of 8 a.m. and 5 p.m., and regular use is prohibited outside of emergencies. Crucially, the draft clarifies that co-located power plants and gas turbines are not allowed as part of data center operations.
  • Accessory Loophole Closed: To prevent developers from building massive facilities under the guise of secondary uses, accessory data centers are now capped at the lesser of 25,000 square feet or 49.9% of the building's total floor area.
  • Ratepayer Protection: Developers must provide concrete evidence that their facilities will not shift infrastructure or energy costs to residential utility customers, and they must bear the full cost of any required grid or utility upgrades.
