Over 70 municipalities across New Jersey have adopted resolutions banning hyperscale AI data centers, driven by environmental concerns over water consumption, chemical use, and electric grid strain. The surge in local grassroots opposition follows the passage of New Jersey's Data Center Fair Share bill (A796/S731), which requires facilities larger than 50 megawatts to construct and fund their own power generation infrastructure.

According to an August 14, 2026 report by Clean Water Action, 81% of New Jersey voters express concern regarding the environmental footprint of large-scale computing facilities. In response, more than 70 towns have enacted local ban resolutions, while 30 additional municipalities have pending ordinances to block hyperscale developments.
Hyperscale AI data centers typically consume between 1.0 million and 2.5 million gallons of water daily for cooling—an amount equivalent to the daily water demand of 3,300 to 8,300 households. In addition to direct water extraction, environmental advocates warn that alternative closed-loop cooling systems rely on large volumes of per- and polyfluoroalkyl substances (PFAS).
At the state level, Governor Mikie Sherrill recently signed the Data Center Fair Share bill (A796/S731). The legislation protects residential ratepayers from subsidizing energy infrastructure by requiring data centers exceeding 50 MW to build and pay for their own on-site or dedicated power generation. However, over 60 environmental and community groups are calling for a comprehensive statewide moratorium on facilities larger than 20 MW, citing measures taken by neighboring New York.
